Justice Department, Emord & Associates jointly move June 1 to dismiss folic acid/NTD supplement health claim litigation based on agency's allowance of claim when accompanied by disclaimer. Pearson plaintiffs also will file suit within next 60 days challenging FDA's decision to deny antioxidant vitamin/cancer claim. Complaint will target FDA's failure to evaluate disclaimer language.
