Executive Summary
U.S. Court of Appeals denies Chesebrough-Pond's request for a reconsideration of a Sept. 21 ruling in favor of Venture Stores in trademark infringement litigation between the firms. The Sept. 21 decision overturned a lower court ruling that Venture Stores, by selling a private-label version of Vaseline Intensive Care Lotion, infringed the trademark, trade dress and patent rights related to Chese-Pond's product. The appeals court had rejected Chese-Pond's claim that consumers had difficulty distinguishing between its Vaseline Intensive Care Lotion and Venture's private-label brand ("The Tan Sheet" Oct. 17, p. 8)
