FDA MOTION TO DISMISS NLEA LEGAL CHALLENGE DENIED in a June 3 ruling by the Tenth Circuit Court of Appeals. The Denver federal appellate court denied the government's April 29 motion to dismiss an April 1 lawsuit suit filed by Jonathan Emord (Washington, D.C.- based Emord & Associates) on behalf of Mineral Resources International and Trace Minerals Research, and has given Justice Department attorneys until July 12 to submit the agency record to the court. The suit is one of several charging that current FDA regulation of dietary supplements is unconstitutional ("The Tan Sheet" May 9, p. 13).
