His remarks come in the wake of two failed attempts to invoke cloture May 4 on an substitute amendment to the "Product Liability Fairness Act" (HR 956). The substitute, offered by Sen. Gorton (R-Wash.) based on S 565, includes a malpractice reform amendment crafted by Sen. McConnell (R-Ky.). Sen. Hatch (R-Utah) speculates May 4 "Sen. McConnell's amendment will survive" but says the fate is less certain for an amendment offered by Majority Leader Dole (R-Kan.) that would impose caps on punitive damages in all civil litigation...
