The Centers for Medicare & Medicaid Services may not issue the Medicare Modernization Act Title I and Title II final implementing regulations until after the Jan. 18 and 19 Senate confirmation hearings for HHS Secretary nominee Mike Leavitt.

"We expected to get it out in mid-January. We are still targeting this month," CMS Medical Advisor Richard Lawlor said during an "open door" forum Jan. 13. "That is impending, that is imminent."

"Certainly we will have them out this quarter, but hopefully we will still make this month."

"As you know, there is a lot going on. We're looking forward to seeing the new secretary get through his confirmation hearings next week. So there's a lot happening now," Lawlor said.

Leavitt will testify before the Senate Health Committee Jan. 18 and before the Finance Committee Jan. 19 (1 ).
