Executive Summary
Calif. bill requiring private litigants to include certificate of merit demonstrating good cause for public Prop 65 warnings signed by Gov. Gray Davis Oct. 8. Legislation cleared Assembly Sept. 13 and Senate a day later. SB 471, which aims to halt "abusive actions brought by private persons containing little or no supporting evidence," requires a private plaintiff to "consult with a person of appropriate knowledge and expertise to establish an exposure to a listed chemical" (1"The Tan Sheet" Aug. 6, p. 7). Separately, state's Office of Environmental Health Hazards Assessment is seeking public comments by Nov. 2 on first in series of Prop 65 draft regulatory amendments to "replace outdated terminology, to make grammatical corrections and to consolidate and alphabetize definition terms"
