Executive Summary

Attorneys general from 32 states and the District of Columbia reach a settlement with Airborne Health following investigations into Airborne's marketing claims. Victoria Knight-McDowell, founder and CEO of the Bonita Springs, Fla.-based effervescent dietary supplement maker, says the Dec. 16 settlement concerns "language that had already been dropped from our advertising and labeling," but the firm "wanted to close the book on these legal and regulatory issues." A final judgment issued the same day by a California state court in San Diego County enjoins Airborne from making cold remedy or sore throat relief claims. The company previously agreed to pay up to $30 million in a settlement with the Federal Trade Commission (1"The Tan Sheet" Aug. 18, 2008, p. 8)
