The Abbott Labs subsidiary filed suit against the food and confectionary firm and "Zone" diet guru Barry Sears, PhD, for trademark infringement in Massachusetts district court. The suit alleges that Hershey's SmartZone nutrition bar - scheduled for launch in the third quarter - infringes on Abbott's marks for ZonePerfect products and "is likely to cause significant and irreparable consumer confusion regarding ZonePerfect's ZONE marks."
