Executive Summary
Kansas House bill No. 2538, which would allow the sale of nonprescription drugs in vending machines, is before Gov. Bill Graves (R) after passing the House March 22 by a 122-1 vote. According to bill language, no more than 12 different OTCs could be sold per machine, while a notice containing the state board of pharmacy's phone number and advising consumers to check the expiration date on the product would have to be displayed on the machine. Kansas is one of the last remaining states not allowing the sale of OTCs in vending machines; Arizona House bill No. 2046, a similar measure, passed the Senate with technical amendments March 8 to be reconsidered by the House.
