Texas OTC Drug Storage Proposal "Unnecessary, Burdensome" - NDMA

Executive Summary

The new storage and handling requirements for OTC drugs recently proposed in Texas are "unnecessary to protect the public health; unduly burdensome on wholesalers and manufacturers; and disruptive of the national uniformity of drug laws," the Nonprescription Drug Manufacturers Association asserts in Jan. 22 comments to the state's health department.

Texas OTC storage reg

Final proposed version of the Texas Department of Health's storage and handling requirements for OTC drugs to be voted on at the board's Oct. 15 meeting. As expected, the reg has been rewritten to incorporate "very minimum standards" for OTC wholesalers, TDH said. As originally drafted, the reg would have applied federal storage standards to OTCs. CHPA and CTFA had lobbied for less stringent standards at a public meeting earlier this year (1"The Tan Sheet" Feb. 22, p. 20). Once approved by TDH, the proposed rule will be published in the Texas Register. A final version could come into effect by March 2000
