McKESSON/ALCO ANTI-MERGER FTC ARGUMENT PERSUASIVE PRECEDENT Judge Stanley Sporkin said in his July 31 ruling preliminarily enjoining the proposed Cardinal Health/Bergen Brunswig and McKesson/AmeriSource mergers in D.C. federal court. "Back in 1988, if the defendants had made the same representations as they make today -- promising not to raise their prices after the merger -- competition and pricing in the market could have been expected to remain about the same," Sporkin commented.
