Product liability: NDMA reiterates support for "FDA defense" language in the Senate product liability bill in a July 31 statement submitted for the record to the Senate Judiciary Committee. The FDA defense clause provides that punitive damages will not be awarded in cases involving products approved by FDA, which NDMA said "will discourage unmeritorious lawsuits, facilitate settlements and encourage manufacturers to continue to develop and market beneficial products."
