Executive Summary
FDA files motion to consolidate three lawsuits challenging the constitutionality of Nutrition Labeling & Education Act final rules for dietary supplements. FDA also asked for an extension until Aug. 11 to file briefs. The suits, which were filed in San Francisco circuit court by attorney Jonathan Emord, are currently being reviewed by a three-judge panel to determine whether the court has jurisdiction. A similar case filed by Emord on behalf of Mineral Resources International and Trace Minerals Research is pending in Denver federal appeals court ("The Tan Sheet" July 11, p. 17)
