BAYER TRADEMARK USE INJUNCTION AGAINST BAYER AG REMANDED by the U.S. Court of Appeals for the Second Circuit to the lower district court in a Jan. 7 ruling. The appeals court upholds much of a 1992 decision by the U.S. District Court for the Southern District of New York that favors arguments by Sterling Winthrop and curtails the use of the Bayer name by Bayer AG. However, the ruling also states that the injunction imposed against the German company is too broad. Sterling Winthrop filed the original suit against Bayer AG in May 1990.
