Executive Summary

The Senate bill would permanently ban use of the "unfairness" standard in rulemaking affecting the advertising industry. The House bill, which cleared that chamber June 21, places no restrictions on FTC's rulemaking authority. FTC's use of the unfairness standard to regulate the ad industry has been a long-standing impediment to reauthorization, with the Senate favoring restrictions and the House consistently opposing such limitations. FTC has not been reauthorized since 1980.
