Supreme Court Declines PBM Transparency Law Case

The U.S. Supreme Court could revisit the Pharmacy Care Management Association's suit regarding a Maine PBM transparency law later this year, the group said June 5. The court declined to hear the PBM trade group's appeal of a November Boston federal court decision, which upheld the Maine law. PCMA argues that the law, which designates pharmacy benefit managers as fiduciaries and imposes financial disclosure requirements, would result in an increase in prescription drug costs of up to 10% (1 (Also see "PCMA To Continue To Fight D.C. PBM Transparency Law" - Pink Sheet, 3 May, 2006.)). However, PCMA asserts that if its ongoing case in D.C. federal court - regarding the District of Columbia's similar D.C. AccessRx Act of 2004 - conflicts with the Boston decision, there will be grounds for a Supreme Court review. PCMA said a ruling on the group's motion for summary judgment in the D.C. court could be handed down in the fall. |
