Pharmacy Freedom Fund lawsuit against pharmacy benefit managers delayed until early 2003 while organization decides on optimal legal strategy. Group is likely to file two suits: (1) permanent injunction against the AdvancePCS, Express Scripts and Merck-Medco joint venture RxHub; and (2) multi-plaintiff private action or class action against PBMs on grounds of "restraint of trade" and price-fixing.
