Executive Summary

The Pharmaceutical Research & Manufacturers of America's request for a preliminary injunction against Florida Medicaid's preferred drug program will be denied, Tallahassee, Fla. federal court Magistrate Judge William Sherrill says during Sept. 20 hearing. "I don't see that the federal law prohibits a prior authorization program that furthers other state long as it keeps intact the idea of the [federal Medicaid] formulary," Sherrill said. The program was approved as a Medicaid plan amendment by HHS Sept. 18. Manufacturers are expected to offer supplemental rebates to the state in exchange for having their drugs on the preferred list
