Pricing suit settlement implementation could begin in 90 days following May 30 appeals decision.
Executive Summary
PHARMACY PRICING SUIT SETTLEMENT IMPLEMENTATION COULD BEGIN BY END OF AUGUST, several parties to the settlement have indicated. A May 30 decision by Chicago federal appeals court dismissed appeals by pharmacies that opted out of the settlement and by class members who are not named plaintiffs. If further appeals by those parties are not submitted to the Supreme Court, the 11 settling drug manufacturers will implement the terms of the June 1996 settlement within 90 days.
