Executive Summary
Bergen Brunswig's request for an injunction forcing Durr-Fillauer to provide all the information given to Cardinal as part of the latter two companies' "definitive" merger agreement will be considered by Delaware chancery court on Aug. 6. Durr told Bergen Brunswig in a July 24 letter that "it would not be in the best interests of our shareholders to provide Bergen Brunswig, a major competitor of Durr- Fillauer, with access to confidential and sensitive information," However, Durr added that "there is no impediment to [Bergen] making a higher offer".
