Operation Desert Storm lawsuit

Executive Summary

A civil action filed Jan. 11 by Public Citizen's Health Research Group, seeking to stop the Department of Defense from using unapproved drugs and vaccines on Desert Storm soldiers without their consent, was dismissed by the D.C. federal court on Jan. 31. The complaint ("The Pink Sheet" Jan. 14, T&G-13) was thrown out on the grounds that the actions of the two defendants - - the DoD and HHS -- concern military matters and are therefore not subject to judicial review. HRG filed an appeal to the decision on Feb. 1.
