Robins settlement to U.S. Supreme Court

Executive Summary

Would mean another delay in the American Home Products/A. H. Robins merger if high court accepts case. Public Citizen Litigation Group attorney Alan Morrison, who represents a group of 900 Dalkon Shield plaintiffs, has said his group will file a writ of certiorari Sept. 14 for high court review of a key part of the $ 2.5 bil. Dalkon settlement fund that is part of Robins' reorganization plan. Although the plan was approved by the Richmond bankruptcy court and a majority of Dalkon claimants, Morrison's group objects to provisions which prevent any future lawsuits against Robins management, individuals or Aetna, the firm's former insurer. Robins and other defendants will have 30 days after Morrison's filing to object to the petition.
