Genex procured the plan in 1983 in anticipation of a long-term supply agreement with Searle for the production of Nutra Sweet. Under a settlement agreement with NutraSweet, now a part of Monsanto, the parties agreed to a mutual release of all claims and the payment of "a nominal sum" to Genex.
