Process patent legislation
Executive Summary
House Judiciary/Courts Subcmte. reportedly is planning a hearing on Rep. Moorhead's (R-Calif.) bill for early 1986. Moorhead bill would make it an infringement to import or sell a product made overseas by a process patented in the U.S. Key feature of HR 1609 is the explicit presumption that requires defendants to demonstrate their products are not violative. Sen. Mathias has a companion bill which is silent on that issue ("The Pink Sheet" Oct. 28, p. 14).
